The petitioners apprehend their arrest in a case registered for the offence under Sections 147, 148, 149, 341, 323, 307, 324, 379, 504 and 506 of the Indian Penal Code. As per F.I.R., all the F.I.R. named accused persons including these petitioners, variously armed, came to the house of informant and assaulted him and his brother. Petitioner no. 1 and co-accused Devendra Prasad Yadav are alleged to have snatched case of Rs. 15,000/- from the pocket of brother of informant, whereas, petitioner no. 2 and co-accused Awadhesh Rai gave knife injury to the informant, causing cut injury on his thumb.

No.67755 of 2022(3) dt.11-05-2023 2/2 It is submitted on behalf of petitioners that as per F.I.R., there is admitted land dispute between the parties and with a view to grab the land of petitioner, this false and concocted case has been lodged by the informant. It is next submitted that though petitioner no. 2 is alleged to have given knife blow, but no sharp cut injury was found by the Doctor on the body of informant. Petitioners have got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Dhaka, Sikrahana, District East Champaran in connection with Ghorasahan (Jitna) P.S. Case No. 268 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
