2. The petitioner is in custody in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. As per allegation in the FIR, total 50 liters of illicit country made liquor has been recovered from without number plate of Hero Splendor Motorcycle and the same belongs to this petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that he has no concern with the said recovery and said vehicle and nothing has been recovered from the possession of

Patna High Court CR. MISC. No.67360 of 2025(2) dt.24-09-2025 2/2 the petitioner and he is in custody since 06.08.2025 and there is no independent witness of seizure list.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In view of the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Court-II, Jamui in connection with Jamui Excise P.S. Case No. 453 of 2025.
