Petitioner is in custody in connection with Andar P.S. Case No. 85 of 2018 for the offence under sections 272, 273, 308 of the Indian Penal Code and Section 30(a) 41(i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He is in custody since 14.5.2018 in connection with seizure of 25.38 liters of liquor. Learned counsel for the petitioner submits that seizure was made from the shop of co-accused Ashok Kumar Gupta and not from the possession of the petitioner.
