The petitioner has filed the present writ petition for a direction to the respondents to select the petitioner for PDS licence for Biraj Panchayat under Imamganj Block, DistrictGaya. Learned counsel for the petitioner submits that in the panel the petitioner was at Sl. No. 1 for PDS licence. However, the petitioner was not granted PDS licence.

In the present case application was invited in

Patna High Court CWJC No.20403 of 2019(2) dt.16-03-2021 2/2 September, 2017. At the relevant time the petitioner was working as Panchayat Shikshak. The petitioner applied for PDS licence on 12.10.2017 while she was Panchayat Shikshak. She tendered resignation on 01.08.2018 which was accepted on 02.08.2018. The resignation was confirmed by the Block Education Officer to the Block Supply Officer on 22.02.2019. Thereafter, the respondents have, notwithstanding the merit position No. 1 in the select list for PDS licence, ignored the candidature of the petitioner.

Since on the date of inviting application, the petitioner was working as Panchayat Teacher, the action of the respondents in not considering the case of the petitioner for grant of PDS licence, does not suffer from any infirmity. The writ petition is completely devoid of any merit. It is, accordingly, dismissed. (Anil Kumar Upadhyay, J) spandey/- U
