The petitioner is apprehending arrest in connection with Jagdishpur P.S. Case No. 358 of 2018 for the offence under Section 30(a) of the Bihar Excise and Prohibition Act, 2016. Allegation against the petitioner is that in the instant case approximately 30 litres mahua desi liquor was seized from a motorcycle.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and the motorcycle from which liquor was seized does not belong to the petitioner. Considering the fact that the petitioner has no criminal antecedent and the motorcycle from which liquor was seized, does not belong to this petitioner, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within

No.70545 of 2019(5) dt.05-03-2020 2/2 four weeks from today, on furnishing bail bond of Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Special Judge (Excise), Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 358 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

In the event in future, if the petitioner is found to be involved in any such activities, the Court below shall be at liberty to cancel his bail bonds.
