2. Petitioner is in custody in a case registered for the offence under Section 364(A) of the Indian Penal Code.
3. As per the allegation in the FIR, petitioner and other co-accused persons are alleged to have committed kidnapping of the minor son of the informant and asked for ransom of Rs. 5 lakhs in return of returning of informant's son.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that name of the petitioner has been transpired on the basis of confessional statement of co-accused person, namely, Amit Kumar and the said Amit Kumar has
Patna High Court CR. MISC. No.68963 of 2025(5) dt.18-12-2025 2/3 already granted bail by learned Trial Court in Sessions Trial No. 501 of 2024, 149/2024. He next submits that from perusal of the statement of the victim recorded under Section 164 Cr.P.C., it appears that minor son of the informant has stated nothing about the petitioner and the minor child has been recovered from the jungle. He next submits that charge-sheet has already been submitted but no TIP has been conducted during investigation. He next submits that petitioner has got one criminal antecedent as stated in para-3 of the bail petition and he is in custody since 22.01.2025.
5. Learned APP for the State opposes the prayer for bail of the petitioner.

From perusal of the First Information Report, case diary and impugned order dated 24.07.2025, it appears that name of the petitioner has been transpired on the basis of confessional statement of another co-accused person, namely, Amit Kumar and the said Amit Kumar has already granted bail by learned Trial Court in Sessions Trial No. 501 of 2024, 149/2024. So, considering the aforesaid facts and circumstances of the case, submission of learned counsel for the petitioner as well as the fact that there is no specific allegation against the present petitioner, let the above named petitioner be released on

No.68963 of 2025(5) dt.18-12-2025 3/3 bail, on his furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Sherghati, Gaya, in connection with Sessions Trial No.160 of 2025/14 of 2025 arising out of Imamganj P.S.
