The petitioner seeks pre-arrest bail in connection with Simri P.S.Case No. 177 of 2017 registered under Sections 147, 149, 341, 323, 307, 427, 504 and 506 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that there is admitted land dispute between the parties. The petitioner had filed a case against the informant and his family members on the date of occurrence itself i.e. on 25.07.2017 and in retaliation to that the instant case was registered on 26.07.2017. He submitted that even otherwise the injuries alleged to have been caused by the petitioner on the person of the informant were found

Patna High Court Cr.Misc. No.59272 of 2017 (2) dt.13-12-2017 2/2 simple in nature and, hence, the ingredients of the offence punishable under Section 307 of the Indian Penal Code would not be attracted.

Learned counsel for the State opposed the application for grant of pre-arrest bail.

Considering the nature of allegation made in the FIR as also the submissions made by the petitioner, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- IV, Buxar in connection with Simri P.S.Case No. 177 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
