JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Rajauli P.S. Case No. 335 of 2017 instituted for the offence punishable under Section 30 (a) of the Bihar Excise Prohibition Amendment Act, 2016.

The allegation is regarding recovery of 22 liters of illicit Mahua wine from the Andharwari More from where the petitioner is said to be apprehended by the police. Learned counsel for the petitioner submits that in fact no recovery has been made from the petitioner and he has clean antecedent. It is stated that the petitioner is languishing in custody since 03.11.2017.

Patna High Court Cr.Misc. No.59108 of 2017 (2) dt.22-12-2017 2/2 Considering the nature of accusation, period of custody undergone and clean antecedent, I deem it fit and appropriate to direct the release of the petitioners. Accordingly, the petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IICum- Special Judge, Nawada in connection with Rajauli P. S. Case No. 335 of 2017.
