The petitioner is apprehending his arrest in connection with Sahar P.S.Case no.204/2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

As per FIR, there is allegation of recovery of 108 ltrs. of english wine from the Bolero vehicle and the petitioner is the Driver of the vehicle.

Submission of the learned counsel for the petitioner is that he has nothing to do with the seized articles and having no criminal antecedent.

Heard learned A.P.P. , who has opposed the prayer for bail.

Having heard both sides and in view of the facts and

No.62604 of 2019(4) dt.09-12-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid direction, this application is dismissed.
