1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 315, 494, 498(A), 34 and 406 of the Indian Penal Code & Sections 3⁄4 D.P. Act.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant. It is next submitted that petitioner is the brother-in-law (Devar) of the informant. It is next submitted that the informant was married to brother of the petitioner, namely, Manoj Kumar, who has been
Patna High Court CR. MISC. No.73492 of 2024(2) dt.03-03-2025 2/2 granted the privilege of anticipatory bail by an order dated 06.04.2023 in ABP No.3524/2024 passed by the learned Sessions Judge, Sitamarhi. It is next submitted that even allegation against the petitioner is general and omnibus in nature.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Choraut P.S. Case No.145/2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
