2. The petitioners apprehend their arrest in connection with Banka P.S. Case No. 244 of 2023 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 504, 506, 307 and 379 of the Indian Penal Code.
3. As per the prosecution case, all the accused persons assaulted the informant, her mother-in-law and her sister-in-law. They are also alleged to have called her Dayan.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.72912 of 2023(2) dt.07-11-2023 2/2 petitioners have falsely been implicated in this case. Parties are agnates. As per the injury report, the injuries sustained by the informant and her mother-in-law and sister-in-law are simple in nature.
5. Learned APP for the State opposes the prayer for grant of anticipatory bail.
6. Considering the rival submissions, nature of injuries and facts and circumstances of the case, prayer for bail of the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within six weeks from today, let the petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka, in connection with Banka P.S. Case No. 244 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) shashank/- U T
