Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. He submits that petitioner's name has come in the case on the confessional statement of co-accused Dharmendra Padey who is the Gotia of the deceased with whom he has dispute of property. Petitioner is merely a co-villager and is not concerned with day to day affair of the deceased. Nothing incriminating has come against the petitioner during investigation to connect him with the alleged offence.
Considering the facts of the case, let the petitioner,
Patna High Court CR. MISC. No.67534 of 2019(4) dt.06-03-2020 2/2 above named, in the event of surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bikramganj, Rohtas in Nasrignj Police Station Case No. 33 of 2019/GR No. 254/2019 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
