2. The petitioner seeks bail in connection with Asthawa P.S. Case No. 221 of 2020 registered for the offence punishable under Sections 363 and 365/34 of the Indian Penal Code to which Section 366(a) of the I.P.C. was added.

3. As per the prosecution case, the petitioner and others are said to have kidnapped the victim.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to suspicion. The petitioner is in jail since 10.08.2023. The statement of the victim under Sections 161 and 164 of the Cr.P.C. does not create confidence in the prosecution case.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class Nalanda at Biharsharif in connection with Asthawan P.S. Case No.221 of 2020.
