ANJANA MISHRA ORAL ORDER 26-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.05.2018 in connection with Spl. Case No.09/2018, arising out of Forbesganj P.S. Case No.350 of 2018 registered for the offence under Sections 21(b) and 22 of the N.D.P.S. Act.

The petitioner is the auto Driver in whose vehicle certain bottles of cough syrup were seized while he was going to Jogbani from Forbesganj.

Learned counsel for the petitioner submits that the auto of the petitioner had been hired at Rs.500/- and he was not having any knowledge that the cough syrup was carried in his vehicle. The petitioner is also having no criminal antecedents and

Patna High Court Cr.Misc. No.39972 of 2018 (3) dt.26-07-2018 2/2 is rotting in jail since 18.05.2018.

Considering the aforementioned facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-Cum-Special Judge, Araria, in connection with Spl. Case No.09/2018, arising out of Forbesganj P.S. Case No.350 of 2018.
