JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 18-10-2024 The present petition has been filed for modification of order dated 31.08.2023 passed in Cr. Misc. No. 57413 of 2023 with prayer to extend further period of surrender of the petitioner and furnishing the bail bond and sureties as detailed in the aforesaid order.

2. Learned counsel for the petitioner submits that due to non-communication to the Pairvikar of this case, petitioner could not surrender before the Court concerned within the prescribed time given by this Court.

3. In view of the facts and circumstances, the present Modification Application stands allowed, subject to cost of Rs. 2,000/- to be paid by the petitioner with District Legal Services Authority, Samastipur within four weeks.

4. Further four weeks time from today is granted to

Patna High Court CR. MISC. No.75020 of 2024(2) dt.18-10-2024 2/2 the petitioner to surrender before the Court concerned with the conditions as stated in the aforesaid order dated 31.08.2023.

5. Accordingly, the order dated 31.08.2023 passed in Cr. Misc. No. 57413 of 2023 stands modified to the above extent.
