The petitioner seeks bail in connection with Chautham P.S. Case No. 70 of 2019 (Session Trial No. 219 of 2019), registered for offence punishable under Sections 341, 323, 307, 504, 302, 379 and 34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case merely on previous enmity and both the parties are agnates. Further submission is that no specific allegation has been levelled against the petitioner and the allegation levelled against the petitioner is general and omnibus in nature. The allegation is that all the four persons
Patna High Court CR. MISC. No.64202 of 2019(2) dt.07-11-2019 2/2 assaulted the victim, however injury report reflects only one injury. The petitioner has no criminal antecedent and he is in custody since 27.03.2019.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Khagaria in connection with Chautham P.S. Case No. 70 of 2019 (Session Trial No. 219 of 2019).
