Petitioner apprehends his arrest in Kutumba P.S. case no. 133 of 2017, instituted for the offence under Section(s) 147,149, 341, 323, 427,353, 379 and 504 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner. The other co-accused persons having similar allegation have already been granted anticipatory bail by order dated 11.12.2017 passed in Cr. Misc. no. 58210 of 2017 (Annexure-5 to supplementary affidavit) In the written report, it is alleged that on account of death

Patna High Court Cr.Misc. No.60855 of 2017(3) dt.13-02-2018 2/3 of one Reeta Devi her family members became violent and assaulted the staffs of the hospital. The informant has named 35 accused persons in the F.I.R. including this petitioner and has also alleged that there were also 250 unknown persons at the time of occurrence. In this manner, there is general and omnibus allegation In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Kutumba P.S. case no. 133 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.

VII, Aurangabad, District Aurangabad, subject to the conditions as laid down under Section 438(2) Cr. P. C.
