Let the defect(s), as pointed out by the office, be removed within a period of four weeks from today. The accused/petitioner is named in the F.I.R. and apprehend his arrest in connection with Chainpur P.S. Case No. 100 of 2019 registered for the offences punishable under Sections 406, 420, 467, 468 and 120B of the Indian Penal Code. The allegation against the petitioner is to cheat informant and also to breach of trust by creating forged document along with other co-accused persons, who secures a loan from IndusInd Bank for purchasing tractor from Rohit Automobiles.

No.70115 of 2022(2) dt.05-05-2023 2/3 Learned counsel appearing on behalf of the petitioner submitted that maximum allegation as available against this petitioner is to introduce the informant with Bank Manager of IndusInd Bank being co-villagers as informant expressed his interest to purchase a tractor for agriculture purpose and as such desirous to secure a Bank loan. It is pointed out that as certain documents were executed in presence of this petitioner, a suspicion arises, where, petitioner apparently not a beneficiary out of financial transactions.

Learned APP duly assisted by learned counsel appearing on behalf of the informant, opposes the prayer of bail. Considering the aforesaid facts and circumstances of the case, as the role of petitioner appearing limited only as an introducer of informant with Bank officials, accordingly above named petitioner, in the event of his arrest or surrender before learned court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabhua /concerned Court, where the case is pending in connection with Chainpur P.S. Case No. 100 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. with further
