2. The petitioners apprehend arrest in connection with Daraunda P.S. Case No. 361 of 2025 dated 17.07.2025, registered for the offence punishable under Sections 126(2), 115(2), 117(2), 109, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in short, is that the petitioners are said to have assaulted the informant by means of lathi, danda and iron rod due to which the informant sustained head injury. It is further alleged that
Patna High Court CR. MISC. No.69065 of 2025(2) dt.24-09-2025 2/3 when the informant's mother and wife came to rescue him, they were also assaulted by the accused persons.
4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is submitted that both the parties are closely related to each other. It is submitted that the informant is full brother of husband of Mina Devi (petitioner no. 1), namely, Ashok Singh. It is submitted that the allegation against the petitioners are general and omnibus and the injury of the injured is said to be simple in nature. Lastly, it has been submitted that they have no criminal antecedents.
5. Learned A.P.P. has opposed the prayer for bail of the petitioners.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioners within a period of six weeks from today, in connection with Daraunda P.S. Case No. 361 of 2025, they shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like
