JUSTICE ARUN KUMAR ORAL ORDER 19-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Amdabad P.S.Case No. 149 of 2017 registered under Sections 304B and 120B of Indian penal Code.

Allegation in brief is that informant's daughter got love marriage with the petitioner's brother and it is alleged that he used to make further demand of dowry and all accused persons due to non-fulfillment of dowry killed the informant's daughter. Learned counsel for the petitioner submits that petitioner is the youngest brother of the husband of the deceased and it was a love marriage between the petitioner's brother and the deceased and there is no specific allegation against the petitioner with regard to making demand of dowry and of committing torture and earlier a U.D. case was also lodged by the informant, subsequently

Having considered the aforesaid facts and circumstances, as there is general and omnibus allegation against the petitioner and the deceased has got love marriage with the petitioner's brother and the specific allegation is against husband, so the petitioner, namely , Md. Raihan @ Abu Raihan is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. D.Singh, J.M. 1st Class, Katihar in connection with Amdabad P.S. Case No. 149 of 2017.
