JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-07-2018 The application for grant of regular bail arises out of Chakai P.S. Case No. 85 of 2017, dated 01.08.2017, instituted for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code.

The petitioner, his wife and others are said to have assaulted the informant and other members of the family. The petitioner is alleged to have given orders for assault and has also used lathi to assault one Arvind Barnwal. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.39562 of 2018 (2) dt.06-07-2018 2/2 the investigation reports do not refer to the injuries on the person of aforesaid Arvind Barnwal. The wife of the petitioner is said to have assaulted Dinesh Barnwal, who is said to have been injured in the occurrence. The petitioners are the shareholders in the property and the occurrence had taken place at the time of measurement of land for apportioning the respective shares.

The petitioner is in custody since 28.05.2018. Regard being had to the circumstances in which the occurrence took place and the fact that the dispute arose during the measurement of the land for partition, the petitioner, above named, is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, Jamui in connection with Chakai P.S. Case No. 85 of 2017.
