JUSTICE SANJAY PRIYA ORAL ORDER 21-12-2017 Heard learned counsel for the petitioners and the State. The petitioners apprehend arrest in Town (Ara) P.S. Case No. 252 of 2017 instituted for the offence under Sections-307, 427 & other minor Sections of the Indian Penal Code. It is alleged against the petitioner that while the informant was standing in queue to withdraw the money from ATM, he disturbed the queue and on protest, he assaulted the informant with sharp cut weapon causing injury to him. He also disclosed that he is working in Sadar Hospital as Health Advisor and his brother is a famous criminal. It appears that subsequent to filing of the case by the informant who is Medical Officer, this petitioner has also filed the case against the informant.
The injury report has been filed in supplementary affidavit which shows that the informant has sustained injury by sharp cut object.
Patna High Court Cr.Misc. No.60592 of 2017 (3) dt.21-12-2017 2/2 Counsel for the petitioner has submitted that compromise has also taken place between the parties and compromise petition has been filed in the court below.
This court, seeing the nature of offence committed, is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.
The petitioner is directed to surrender in the court below and seek regular bail which will be considered by the court below taking into account that the matter has been compromised between the parties and disposed of on its own merit without being prejudiced by this order.
