The petitioner is accused in connection with Sour Bazar P.S. Case No. 530 of 2018 registered under sections 341/323/307/354(B)/447/506/34 of the I.P.C. pending in the Court of C.J.M., Saharsa. Subsequently, section 302 of I.P.C. was added.
Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to land dispute and village politics. Further submission is that petitioner is in custody since 01.07.2019. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that in the first information report, there is direct allegation against the
Patna High Court CR. MISC. No.65922 of 2019(3) dt.27-11-2019 2/2 petitioner of assault by means of iron rod on the head of wife of the informant. It is also submitted that petitioner has criminal antecedent.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
