The petitioner, already in custody, seeks bail in connection with Phulwarisharif (Janipur) P.S.Case No. 435 of 2017 registered under Section 393 of the Indian penal Code and 25(1-b) a/26 of the Arms Act.

Allegation in brief is that one loaded country made pistol with live cartridge were recovered from the possession of the petitioner and also a motorcycled suspected to be robbed by the miscreants.

Submission is that motorcycle was not recovered from the possession of the petitioner and he is in custody since 18.07.2017, approximately 08 months, and has clean antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely , Rakesh Kumar alias Lal Babu, is directed
