This application for grant of regular bail arises out of Baruraj P.S. Case No. 180 of 2017, dated 15.12.2017, instituted for the offence under Section 395 of the Indian Penal Code.

A dacoity had taken place in the house of the informant. The petitioner is not named in the F.I.R. and when he was arrested on suspicion, only one mobile phone

Patna High Court Cr.Misc. No.40043 of 2018 (2) dt.10-07-2018 2/2 was recovered from his possession. The petitioner has not been put on test identification parade and is in custody since 15.02.2018.

Learned counsel for the petitioner has submitted that some of the other accused persons of this case have been granted bail by different Benches of this Court.

Considering the aforesaid facts, the petitioner, above named, is directed to be released on bail on his furnishing bail-bond in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur in connection with Baruraj P.S. Case No. 180 of 2017.
