This case was taken up at 10.30 A.M. when no one appeared. Once again at 12:00 P.M. on call, no one appeared on behalf of the petitioners.

The petitioners moved before this Court for quashing of the order dated 18.02.2015 passed by the Judicial Magistrate -2nd Class, Gaya in Complaint Case No. 24 of 2015 (Trial No. 440 of 2017).

As per the complaint, it has been alleged that while the family members of the complainant were returning from Bitho Sharif Mazar, the named accused persons put pistol on

No.1550 of 2018(2) dt.19-01-2023 2/2 the forehead of the complainant and threatened of dire consequences and further took out Rs. 3,000/- from the pocket as also tried to outrage his wife's modesty. In the present case, cognizance was taken on 18.02.2015 under Sections 323, 341, 379 and 504/34 of the Indian Penal Code against the accused-petitioners. Since then lots of water has flown down the ganges.

The complainant has put on oath the fact of the case/allegation against the accused-petitioners after which the cognizance was taken by the concerned Court which need no interference.
