The petitioners apprehend their arrest in Fatehpur P.S. Case No. 98/2018 (G.R. No. 2267/18), registered for the offences punishable under Sections 366(A) and 34 of the Indian Penal Code.

The informant alleged that his daughter had gone to attend the call of nature, but she did not return. During the course of search, the informant came to know that Umesh Prasad Yadav kidnapped his minor daughter with the help of his father, mother and sister-in-law (Bhabhi).

Learned counsel for the petitioners submits that petitioners are sister-in-law (Bhabhi) and mother of Umesh Prasad

There is no material against the petitioners that petitioners in any way helped Umesh Prasad Yadav in kidnapping the daughter of the informant. Umesh Prasad Yadav and the daughter of the informant was having love affair and they fled away. The petitioners have no knowledge about the whereabout of the victim and Umesh Prasad Yadav.

Considering the facts aforesaid and the fact that petitioners are sister-in-law (Bhabhi) and mother of Umesh Prasad Yadav who is said to have kidnapped the victim, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Xth, Gaya in connection with Fatehpur P.S. Case No. 98/2018 (G.R. No. 2267/18), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
