JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-10-2024 The present writ petition has been filed seeking the following reliefs:- "(i) For issuance of writ in the nature of mandamus directing the Respondents authorities, particularly the Respondent Circle Officer, Ghosi to remove the encroachment made by Respondent No.7 and 8 over public land, appertaining to Khata No.965, Plot No.891, 892, 1032, 730 of Mauja -Kurey, Thana No.636, which is recorded in Khatiyan as "Gairmajarua Aam Rasta" and is being used by the villagers as common pathway.

Patna High Court CWJC No.15402 of 2024(2) dt.07-10-2024 2/2 (ii) For further directing the Respondents No.5 i.e. the Circle Officer, Ghosi to initiate Land Encroachment Proceedings, by instituting Land Encroachment Case against the Respondents No.7 and 8, so that encroachment made by them by making pucca masonry construction over the common pathway / road, which is Gairmajarua land, can be removed."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the District Magistrate, Jehanabad for redressal of his aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands disposed off.
