Petitioner, already in custody, seeks bail in connection with Belaganj P.S. Case No.308 of 2017, registered under Sections 147, 148, 149, 323, 325, 307 and 379 of the Indian Penal Code as well as under Section 27 of the Arms Act. Learned counsel for the petitioner submits that earlier prayer of bail of the petitioner was rejected by order dated 27.02.2018, passed in Cr. Misc. No.11606 of 2018 observing that presently the prayer of bail of the petitioner is rejected. However, the petitioner has remained in custody since 14.09.2017 and there is no repetition of opening fire and the injury is simple in nature.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.45044 of 2018(2) dt.01-08-2018 2/2 circumstances, petitioner Mahesh Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XI, Gaya in connection with Belaganj P.S. Case No.308 of 2017.
