JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-01-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor of the State.
The petitioners are apprehending their arrest in connection with Ghosi P.S. Case No. 215 of 2017 registered for offences punishable under Sections 304 (B), 201/34 of the Indian Penal Code.
The husband of the deceased is said to have conspired together with the other co-accused persons and committed the murder of the deceased on account of non fulfillment of demand of dowry.
Learned counsel for the petitioners submits that as far as the petitioner Nos. 1 and 2 are concerned, they are father-in-
Patna High Court Cr.Misc. No.59385 of 2017 (3) dt.08-01-2018 2/2 law and mother-in-law of the deceased and there is no specific allegation of any overt act against these petitioners. It is also submitted that the husband of the deceased is already in custody. Perused the case diary, from which it transpires that the main allegation is against the husband of the deceased, hence I find that the petitioners are entitled for grant of anticipatory bail. Accordingly, the petitioners are directed to be released on anticipatory bail in the event of their arrest/surrender within six weeks from today before the concerned Court in connection with Ghoshi P. S.Case No. 215 of 2017 on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand)each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jehanabad, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
