2. The petitioner has prayed for bail in connection with Shyampur Bhatha (Shyam Bhatha) P.S. Case No. 97 of 2025 registered for the offence punishable under Section 303(2) of the B.N.S., 2023.
3. The case of the prosecution is that one pick-up van was stolen and the FIR was lodged against unknown miscreants.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that during the course of investigation, the name of this petitioner has surfaced on the basis of confessional statement of one Sandeep Kumar. It has also been submitted that from perusal
Patna High Court CR. MISC. No.69944 of 2025(2) dt.08-10-2025 2/2 of the seizure list, it transpires that the stolen pick-up van was recovered on the disclosure of this petitioner. He further submits that nothing has been recovered from the possession of this petitioner rather the pick-up van was recovered from National Highway(NH). Moreover, petitioner is languishing in judicial custody since 18.07.2025.
5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of three cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- III, Sheohar in connection with Shyampur Bhatha (Shyam Bhatha) P.S. Case No. 97 of 2025.
