JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kargahar P.S. Case No. 277 of 2017 instituted for the offences under Sections 272, 273 and 120(B) of the Indian Penal Code and Sections 30(a), 51 and 41 of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of foreign liquor from a Scorpio vehicle in which the petitioner and the accused persons were travelling.

The learned counsel for the petitioner submits that the petitioner is innocent, he is in custody since 01.10.2017. As far as the criminal antecedent is concerned, he is an accused in two other

Patna High Court Cr.Misc. No.60685 of 2017 (2) dt.21-12-2017 2/2 cases of same and similar allegations.

Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Court, Excise, Rohtas at Sasaram in connection with Kargahar P.S. Case No. 277 of 2017.
