JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2017 Earlier prayer for bail of the petitioner was dismissed vide order dated 10.10.2017, passed in Cr. Misc. No. 44790 of 2017 with observation that petitioner may renew his prayer for bail after framing of charge in this case. Submission of learned counsel for the petitioner that now charge has been framed in this case and petitioner has been in custody since 12.06.2017 and is ready to abide by any condition imposed on him for grant of bail.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts as well as in view of the order dated 10.10.2017, passed in Cr. Misc. No. 44790 of 2017, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM - Patna, in connection with
Patna High Court Cr.Misc. No.60587 of 2017 (2) dt.13-12-2017 Sachiwalaya P.S. Case No. 76 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) Petitioner shall appear before the local police station of his areas in the first week of each month at least for a period of one year so that the police may watch his conduct during aforesaid period.
(iv) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
It is made clear that failure to comply any of the above order shall make the petitioner liable for cancellation of his bail bonds.
