The petitioner is in custody since 23.08.2019 on his surrender in connection with Bairgania P.S. Case No.181 of 2019 registered for the offence under Section 30(A) of the Bihar Prohibition and Excise Act.

It is submitted by the learned counsel for the petitioner that the alleged recoveries were not from the conscious possession of the petitioner, rather from the house of one Dharmendra Raut and Chhedi Mahto, who have disclosed the name of the petitioner.
