This application, for grant of regular bail, arises out of Special Case No. 09 of 2018 corresponding to Forbesganj P.S. Case No 350 of 2018, disclosing offences under Sections 21(b) and 22 of the N.D.P.S. Act.
Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, 500 bottles of cough syrup recovered from the Tempo bearing No. B.R. 38P-0188 which does not come under the purview of N.D.P.S. Act, therefore, no case under Section 21(b) and 22 of the N.D.P.S. Act is made out. The petitioner is languishing in custody for the last two months.
Patna High Court Cr.Misc. No.40610 of 2018 (2) dt.17-07-2018 Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Araria, in connection with Special Case No. 09 of 2018 corresponding to Forbesganj Police Station Case No. 350 of 2018.
