1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for bail in connection with Sessions Trial no.347 of 2024 (arising out of Bhagwanpur P.S. Case no.223 of 2023) registered under section 366A of the Indian Penal Code.

3. As per the prosecution case, the informant states that the accused persons including the petitioner herein abused and assaulted the informant and his wife and forcibly took away his 13 year old daughter. His daughter was taken away by the petitioner and one Bholu Kumar.

4. Learned counsel for the petitioner submits that the earlier prayer for bail of the petitioner was rejected vide order dated 9.4.2024 passed in Cr. Misc. no.794 of 2024 giving liberty to the petitioner to renew his prayer for bail on completing one

Patna High Court CR. MISC. No.71925 of 2024(4) dt.13-12-2024 2/2 year in custody or after framing of charge, whichever is later. The petitioner has remained in custody for more than one year since 12.9.2023 and referring to the ordersheet of the learned trial Court brought on record in the supplementary affidavit filed on 6.12.2024, learned counsel for the petitioner submits that charge has been framed against the petitioner on 22.5.2024.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the liberty granted in the earlier order of rejection dated 9.4.2024, the petitioner having remained in custody since 12.9.2023 and charge having been framed in the learned trial Court on 22.5.2024, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.347 of 2024 (arising out of Bhagwanpur P.S. Case no.223 of 2023) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II, Begusarai.
