2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 25(1-b)(a), 26 and 35 of the Arms Act.

3. As per prosecution case, acting on a tip off, the informant intercepted a tempo and apprehended one person while others managed to flee away. A mobile phone and a loaded pistol were recovered from the said apprehended accused person. He disclosed name of the petitioner as his accomplice.

4. It is submitted on behalf of the petitioner that no incriminating article has been recovered from the conscious possession of the petitioner. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused. Petitioner claim clean antecedent.

5. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.68662 of 2025(2) dt.07-10-2025 2/2 for pre-arrest bail.

6. Considering the aforesaid facts of the case, prayer for bail of this petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the District and Additional Sessions Judge III, Civil Court, Munger in Safiyasarai Police Station Case No. 118 of 2024, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
