The grievance of the petitioner in the present writ application is non-consideration of his case for grant of promotion under Assured Career Progression.

Learned counsel for the petitioner would submit that the petitioner joined as an Assistant Teacher in Upgrade Primary School, Mahima, Itarhi, Buxar on 19.06.1975. He got first time bound promotion on completion of ten years of service. The scheme of time bound promotion was available up to 31.12.1995. In place of time bound promotion scheme of

Learned counsel for the petitioner would submit that the petitioner has superannuated on 31.12.2012 but petitioner was not considered for the grant of benefit of second and third A.C.P./M.A.C.P. Considering the aforesaid, the present writ application stands disposed of with a direction to the respondent District Programme Officer (Establishment) to examine the claim of the petitioner, whether the petitioner entitled to grant of benefit under A.C.P./M.A.C.P. In case, if it is found that he was eligible for grant of benefit, the respondents may consider his case for benefit under the prescribed scheme. Necessary decision with regard to the grant of promotion and consequential benefits may be taken by the respondents at the earliest, preferably within a period of two months from the date of receipt/production of a copy of this order.
