1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Tajpur Police Station Case No. 119 of 2025, disclosing offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2022.

3. As per the prosecution case, police, on 23.07.2025, got the secret information that illicit liquor was being transported through a vehicle. The police intercepted the bolero pick-up vehicle and recovered 1240.92 liters of foreign liquor and arrested two persons and two to three persons

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case due to alleged high-handedness of the police. The recovery of 1240.92 litres of English liquor from Pickup Bolero bearing Registration No. BR46GA1026 has no connection with the petitioner. The petitioner is neither the owner nor the driver of the vehicle. The petitioner was not present at the place of occurrence. The arrested persons disclosed the name of the persons who fled away including the petitioner.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the justification given by the petitioner, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-II, Samastipur, in connection with Tajpur Police Station Case No. 119 of 2025, subject to the condition laid down under Section
