JUSTICE ARUN KUMAR ORAL ORDER 09-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 26.9.2017 seeks bail in Hathida PS Case No. 66 of 2017 registered under Sections 399, 402 of the IPC and Sections 25(1-b)a, 26 and 35 of the Arms Act. The allegation in brief is that the police apprehended some miscreants in the night on the highway and recovered some arms and cartridges from their possession.

Learned Counsel for the petitioner submits that only one cartridge was recovered from the3 possession of the petitioner, though he has five criminal antecedents but merely on the basis of confessional statement he was made accused in those cases and in four cases out of five he is on bail and in the fifth case he was remanded from this case and he is in custody since 26.9.2017. Having considered the said facts and circumstances, the petitioner, namely, Ravi Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM -cum4th Sub Judge, Barh in connection with Hathida PS Case No. 66 of 2017.
