The petitioner has prayed for bail in a case registered for the offence punishable under sections 364, 366(A)/34 of the Indian Penal Code.

The allegation against he petitioner is that he along with other co-accused persons kidnapped the daughter of the informant for the purpose of marriage.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. In statement recorded u/s 164 Cr.P.C., she has stated that petitioner along with two others intercepted her in a tempo but she has not made any allegation of physical abuse against any one. She inclined to go at Chennai to meet her boy friend

Patna High Court CR. MISC. No.70164 of 2022(3) dt.18-04-2023 2/2 and during that course, she took an auto for Station in which petitioner and two others were sitting. Her age has been assessed by the learned judicial Magistrate as about 17 years. Petitioner is languishing in judicial custody 2.9.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna City, Patna in connection with Daniyawan P.S. Case No. 143 of 2022.
