2. The petitioner seeks bail, in connection with Mahnar P.S. Case No.255 of 2024 registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.
3. The case of the prosecution is that the police on a secret information regarding selling of foreign liquor in a poultry and goat farm raided the place and on search 33.075 liters of foreign liquor was recovered from the poultry and goat farm of one, Mohan Singh. The petitioner is said to be partner in the illicit trade of liquor.
4. Learned counsel for the petitioner contended that nothing has been recovered from the physical possession of the petitioner and the petitioner has falsely been implicated in this case due to dirty village politics. It is next submitted that the
Patna High Court CR. MISC. No.71686 of 2024(2) dt.05-10-2024 2/2 petitioner is in custody since 07.09.2024.
5. On the other hand, learned APP for the State vehemently opposed the bail application.
6. Considering the nature of allegation, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-II, Vaishali at Hajipur in connection with Mahnar P.S. Case No.255 of 2024.
7. Accordingly, the present bail application stands allowed.
