JUSTICE RAJESH KUMAR VERMA ORAL ORDER 19-03-2026 Heard Mr. Rakesh Kumar Mishra, learned counsel for the petitioner and Mr. Sanjay Kumar Sharma, learned Additional Public Prosecutor for the State and Mr. Parvej Khan, learned counsel for the informant.

2. Petitioner seeks bail who is in custody since 04.07.2025 in connection with Mohania P.S. Case No. 271 of 2025, F.I.R. dated 03.04.2025 for the offences punishable under Section 80 of the B.N.S.

3. According to prosecution case, informant's daughter was killed by petitioner and other for non-fulfillment of demand of dowry.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. Petitioner has been made an accused in this case as he is husband of the deceased. From perusal of the F.I.R, it appears that

Patna High Court CR. MISC. No. 67680 of 2025(4) dt.19-03-2026 2/2 although the petitioner is named in the FIR but there is only general and omnibus allegation of demand of dowry against petitioner and the other accused persons. The petitioner is in custody since 04.07.2025.

5. The learned Additional Public Prosecutor and learned counsel for the informant have vehemently opposed the prayer for bail of the petitioner and submit that post-mortem report of the deceased reveals two injuries was found on the person of the deceased where one was grievous and second was simple in nature.

6. Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail in connection with Mohania P.S. Case No. 271 of 2025 pending in the court of learned A.C.J.M-I, Mohania, Kaimur.

7. Prayer is refused.
