JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-07-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner is in custody since 24.05.2018 in connection with Ballia P.S. Case No. 135 of 2018 registered under Sections 401, 413, 420 and 406/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence. In fact, the only allegation against the petitioner is that he along with others was standing near the SBI ATM and on the basis of suspicion the petitioner has been made accused in this case. The petitioner is rotting in judicial custody for the last two months. Moreover, the co-accused, having more or less similar allegation has already been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 41076 of 2018. Considering the facts and circumstances of the case, let

Patna High Court Cr.Misc. No.41557 of 2018 (2) dt.19-07-2018 the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai in connection with Ballia P.S.
