The petitioner seeks bail in a case registered under Sections-8, 20, 22 & 23 of the NDPS Act.

Allegedly, 7.5 kg of Ganja is recovered in this case. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 11-06-2019. 7.5 kg of Ganja is said to have been recovered in this case. Same is below the commercial quantity. Hence Section 37 of the NDPS Act is not applicable in the present case. There is no compliance of Section 42 & 50 of NDPS Act.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Sitamarhi in connection with Sursand P.S. Case No. 192 of 2018.
