JUSTICE MADHURESH PRASAD ORAL ORDER 19-02-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under section 420 and other allied sections of the IPC. Counsel for the petitioner submits that from bare perusal of the FIR it would appear that the petitioner was merely a ward member and he had not been attributed any responsibility for construction of the toilet. He submits that all the ward members have been implicated in the case as a collective body in the FIR. He submits that other co-accused against whom there is allegation of positive role in the occurrence have been allowed bail vide orders dated 11.11.2017, 19.12.2017 and 11.1.2018, passed in Cr. Mis. Nos. 1887, 60914 and 62960 of 2017. Prior to the lodging of the instant case, the petitioner has no antecedent.

Patna High Court Cr.Misc. No.63144 of 2017 (3) dt.19-02-2018 Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Sheohar in Piprahi Police Station Case No. 124 of 2017 on the following conditions:- One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
