The petitioner is languishing in custody since 19.08.2018 in a case registered for the offences punishable under Sections 8/20(b)(ii)(c)/25/29 of NDPS Act. It is alleged that from the possession of the petitioner 10 kgs ganja (5 packets of 2 kg each) were recovered and similar recovery was made from the possession of co-accused Sunil Rai.

It is submitted by learned counsel for the petitioner that the petitioner is not having any criminal antecedent, statement to that effect has been made in paragraph 3 of the petition and investigation has already been concluded. Learned APP submits that the recovery has been made

Considering the recovery between small and commercial quantity, the investigation already being concluded and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- 1st cum- Special Judge, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 312 of 2018.
