The grievance of the petitioners in the present writ application is against refusal of correction by the CBSE in the names of the father and mother of petitioner no.2 in the certificate and other records of the CBSE.
Patna High Court CWJC No.20955 of 2019(2) dt.17-10-2019 2/3 Learned counsel for the petitioners submits that petitioner no.2 wants correction in the name of his mother as Malti Devi instead of Malti Sinha, whereas the name of father of petitioner no.2 as Vinod Kumar, instead of Vinod Kumar Prasad. Mr. Vinay Krishna Tripathy, learned counsel for the CBSE submits that the CBSE has no role in the instant case, unless there is correction in the school record. The CBSE maintains the record on the basis of the entries made in the school register and unless there is correction in the school register and record, the CBSE is not in a position to consider the request of petitioner no.2 for correction in the names of his father and mother. He further submits that for correction in the record of CBSE certain formalities are required, for which the petitioner has to approach the school, in question, and after completing the formality at the level of the school, the CBSE may consider the case of the petitioner no.2 for correction in the names of his mother and father.
Accordingly, the writ application is disposed of with a direction to the Principal, Saraswati Vidya Mandir, Madhav Nagar, Mahadewa O.P., Siwan to make necessary corrections in the names of the mother and father of petitioner no.2 and only after making necessary correction in the record, the Principal of
Patna High Court CWJC No.20955 of 2019(2) dt.17-10-2019 3/3 the school, in question, shall forward the case for correction in the names of the mother and father of the petitioner no.2, as Malti Devi in place of Malti Sinha (mother) and Vinod Kumar in place of Vinod Kumar Prasad (father) to the CBSE along with a copy of this order and thereafter the CBSE will do the needful at the earliest.
With the aforesaid, the writ application stands disposed of.
