The petitioner seeks bail in anticipation of his arrest in connection with Barun P.S. Case No. 97 of 2018 dated 17.05.2018 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504, 120B of the Indian Penal Code and Section 3/4 of Prevention of Damage to Public Property Act.
For the death of a pedestrian in a road accident, the persons of the locality started protesting and a mob of around 200 persons ransacked the police station. Though the petitioner has been named in the FIR but no specific accusation has been levelled against him. Under similar circumstances, several persons have
Patna High Court Cr.Misc. No.42091 of 2018(2) dt.20-07-2018 2/2 been granted anticipatory bail by different Benches of this Court. Some of the orders granting anticipatory bail to the co-accused with similar allegation have been furnished for the inspection of this Court and they have been kept on record.
Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad (Bihar) in connection with Barun P.S. Case No. 97 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
