JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and 27 of the Arms Act. Petitioners are not named in the first information report but from perusal of impugned order it appears that stolen cattle were recovered from the house of these petitioners. However, it is submitted that FIR named accused Ajay Yadav happens to be relative of the petitioners and even if the factum of recovery assumed to be true, then also, it was co-accused Ajay Yadav who had kept cattle at the house of these petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri S. Kumar, learned Judicial Magistrate 1st Class, Udakishunganj, Madhepura in connection with Gwalpara (Arar) P.S. Case No. 184 of 2018. (Hemant Kumar Srivastava, J) shahzad/- U T
